2.1 Your Responsibility. You are entirely responsible for all content you submit to DishMemory, including recipes, images, descriptions, comments, and any other material ("User Content"). We do not review User Content before it is published and are not responsible for its accuracy, legality, or appropriateness.

2.2 No Endorsement. The views, opinions, and content expressed in User Content are solely those of the respective user. DishMemory does not endorse any User Content and expressly disclaims any liability arising from reliance on User Content.

2.3 Content Prohibited. You agree not to submit User Content that:

• Infringes any third-party copyright, trademark, or other intellectual property rights;
• Contains unlawful, harmful, defamatory, obscene, or offensive material;
• Impersonates any person or misrepresents your affiliation with any person or entity;
• Contains malicious code, viruses, or any software intended to damage or interfere with the Service;
• Violates the privacy rights of any third party;
• Promotes illegal activity or provides instructions for harmful acts.

2.4 Imported Content. DishMemory allows you to import recipes from external URLs and other sources. We are not responsible for the accuracy, copyright status, or legality of content imported from third-party sources. It is your responsibility to ensure that you have the right to use and reproduce such content.

2.5 Reporting. We provide a mechanism for users to report problematic content. While we are not obligated to act on every report, we reserve the right to remove any User Content that we believe, in our sole discretion, violates these Terms or is otherwise harmful.

2.6 Takedown Requests. If you believe that your copyrighted work has been reproduced on DishMemory in a way that constitutes copyright infringement, please contact us at the address in Section 12. We will investigate genuine claims and remove infringing content where applicable.

3.1 AI-Assisted Features. DishMemory uses AI technologies (including large language models and vision models) to extract, parse, and structure recipe content from URLs, images, videos, and other sources. These AI features are provided as tools to assist you and are not infallible.

3.2 No Guarantee of Accuracy. AI-generated or AI-extracted content may contain errors, omissions, hallucinations, or inaccuracies. DishMemory makes no warranty — express or implied — that AI output is correct, complete, or suitable for any particular purpose. You should always review AI-generated content before relying on it, especially for:

• Allergen information and dietary suitability;
• Ingredient quantities, substitutions, and preparation times;
• Nutritional estimates and health claims;
• Food safety instructions and cooking temperatures.

3.3 Health & Safety. DishMemory is not a medical or dietary advisor. Nothing generated or displayed by the Service constitutes medical, nutritional, or health advice. Always consult a qualified professional before making dietary changes or if you have concerns about allergens, intolerances, or medical conditions. DishMemory is not liable for any harm arising from reliance on AI-generated nutritional or dietary information.

3.4 AI and Copyright. When AI extracts a recipe from a third-party URL or document, the underlying intellectual property in the original recipe may remain with the original author or publisher. AI extraction does not transfer ownership or grant you additional rights to reproduce, distribute, or publish that content. You are responsible for ensuring your use complies with applicable copyright law.

3.5 AI Output is Not Professional Advice. AI-generated content — including suggestions, substitutions, nutritional estimates, and recipe adaptations — is provided for informational and entertainment purposes only. It does not constitute professional culinary, medical, dietary, or legal advice.

3.6 Evolving Technology. AI technology evolves rapidly. We reserve the right to change, improve, or replace the AI models and providers used by DishMemory at any time without prior notice. The availability and quality of AI features may vary.

4.1 Your Content. You retain ownership of all content you create and submit to DishMemory. By submitting content, you grant DishMemory a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, and distribute your content solely for the purpose of operating the Service.

4.2 Our Platform. All software, design, branding, trademarks, and other materials produced by DishMemory (excluding User Content) are the property of DishMemory or its licensors. You may not copy, modify, distribute, or create derivative works based on our platform without our explicit written permission.

4.3 Feedback. Any feedback, suggestions, or ideas you share with us about the Service may be used by DishMemory without compensation or attribution to you.

5.1 "As Is" Service. DishMemory is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

5.2 Limitation of Damages. To the fullest extent permitted by law, DishMemory and its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising from:

• Your use of or inability to use the Service;
• Any content submitted by you or other users;
• AI-generated or AI-extracted content, including inaccurate nutritional, allergen, or safety information;
• Unauthorised access to or alteration of your data;
• Any third-party services integrated with or used through DishMemory.

5.3 Cap on Liability. Our total liability to you for any claim arising from your use of the Service shall not exceed the greater of (a) the amount you paid to DishMemory in the twelve months preceding the event giving rise to the claim, or (b) €50.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so some of the above limitations may not apply to you.

You agree to defend, indemnify, and hold harmless DishMemory and its affiliates, officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:

• Your User Content;
• Your use of the Service in violation of these Terms;
• Your violation of any applicable law or third-party rights;
• Any content you import from external sources via the Service.

You agree to use DishMemory only for lawful purposes. You must not:

• Attempt to gain unauthorised access to any part of the Service or its infrastructure;
• Use automated tools, bots, or scrapers to access the Service without our written consent;
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service;
• Use the Service in any way that could harm, disable, or overburden our infrastructure;
• Use the AI features to generate harmful, deceptive, or malicious content;
• Share your account credentials or allow others to access your account;
• Use the Service to collect personal data about other users without their consent;
• Circumvent any access controls, rate limits, or usage quotas.

We reserve the right to suspend or terminate your account without notice if we believe you are violating this Acceptable Use Policy.

8.1 Data You Provide. We collect and store the information you provide when registering and using the Service, including your name, email address, and the content you create. We use this data to operate and improve DishMemory.

8.2 AI Data Processing. When you use AI-powered features, the content you submit (such as URLs, images, or recipe text) may be sent to third-party AI providers to process your request. By using these features, you consent to this processing. Please review the privacy policies of these third-party providers. We do not use your recipe data to train AI models without your explicit consent.

8.3 Data Deletion. You may delete your account at any time from your profile settings. Upon deletion, your personal data and recipes will be permanently removed from our systems, subject to any legal retention obligations.

8.4 Security. We implement reasonable technical and organisational measures to protect your data. However, no system is perfectly secure. We cannot guarantee the absolute security of your information and are not liable for unauthorised access resulting from circumstances beyond our reasonable control.

DishMemory may display links to external websites or allow you to import content from third-party sources. We have no control over those third-party sites and are not responsible for their content, privacy practices, or terms of service. Accessing third-party content is at your own risk.

The display of any third-party content within DishMemory does not imply endorsement of that content or the third party by DishMemory.

We may update these Terms from time to time to reflect changes in the law, our Service, or our practices. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you by email or via an in-app notification.

Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the competent courts located in the Netherlands, unless applicable consumer protection laws in your country of residence provide otherwise.
